Eisner Gorin Secure Probationary Outcome in Vandalism of Synagogue Case

Eisner Gorin partner Alan Eisner was recently quoted in a news publication following the settlement of firm client A.R.'s criminal matter in the Airport Courthouse in Los Angeles.  A.R.'s initials are used out of concern for his privacy. 

The client was initially charged with felony vandalism and the special allegation that his conduct was motivated by bias or hate, i.e. that A.R. committed a “hate crime.”

The charges arose from a bizarre vandalism incident at a Los Angeles synagogue which caused understandable distress to the Jewish community. 

The synagogue's interior suffered significant damage, including to important religious artifacts, leading law enforcement and the District Attorney's office to conclude that A.R. must have been motivated by bigotry.

Through plea negotiations, the defense team presented evidence that A.R.'s conduct was motivated by mental health challenges rather than any animus toward a religious group, or anyone else. 

The defense also provided the prosecuting agency with a detailed memorandum of law arguing that the hate crime special allegation was inapplicable to A.R.'s particular situation and would likely not be sustained if the matter were to proceed to trial.

Ultimately, A.R. accepted responsibility for his conduct by accepting a negotiated plea deal whereby he admitted to vandalism and was placed on probation.  Importantly, the synagogue will be provided with full restitution for the property damage caused in the incident.

LA Times - Why Wasn't Tiger Woods Cited for Speeding After Accident? 

An investigation into the accident that caused serious injuries to Tiger Woods revealed he was driving at almost double the speed limit on Hawthorne Boulevard.

However, law enforcement officials said they would not issue a citation for speeding even though it was determined he was travelling over 80 mph in a 45 mph zone.

The captain of the Lomita sheriff's station said data from his vehicle was not enough to issue a citation for speeding. He said his violation had to be witnessed by a law enforcement officer. 

The LA County Sheriff said it was a solo traffic collision and were are not going to issue a citation for an infraction that was not in a peace officer's presence. This applies to everybody and any any suggestion that Woods received special treatment “is false.”

Dmitry Gorin, a former deputy district attorney in Los Angeles County, said data from the SUV's “black box,” which police said showed the speeding, could be used as evidence to issue a ticket. But as a practical matter, law enforcement agencies require a witness of some kind to issue a speeding ticket.
